Terms of Service

These terms are a draft being prepared before the service launches. The effective date will be finalized and posted at launch.

Article 1 (Purpose)

These Terms set out the rights, obligations, and responsibilities between Ehotraders (the “Company”) and users in relation to the use of the mobile application “Petnyang” (the “Service”) provided by the Company.

Article 2 (Definitions)

• “Service” means the Petnyang application and its incidental features, which let users create pets from their own photos and videos, display them on the device screen, and interact with them.
• “User” means any person who uses the Service under these Terms.
• “User Content” means the photos, videos, images, pets, actions, and similar items that a user selects or creates for pet creation.

Article 3 (Effect and Amendment of Terms)

These Terms take effect by being posted within the Service or on the Company’s website (petnyang.com). The Company may amend these Terms within the bounds of applicable law, and will give advance notice specifying the effective date and reason for any amendment.

Article 4 (Provision of the Service)

• The core features of the Service (adopting and creating pets, on-screen display, voice commands, gyro interaction, etc.) are provided free of charge.
• The Company may add, change, or discontinue features to improve service quality, and will give advance notice of material changes.
• Some additional features may be offered for a fee in the future; the terms of any paid features will be provided separately.

Article 5 (User Content)

• The rights to the photos and videos a user uses for pet creation, and to the pets and actions created from them, belong to the user.
• User Content is, in principle, stored and processed on the user’s device and is not transmitted to the Company’s servers (see the Privacy Policy for details).
• Users must not create or use content that infringes others’ rights, including portrait rights and copyrights.

Article 6 (User Obligations)

Users must comply with applicable laws and these Terms, and must not use the Service to infringe others’ rights or for unlawful or harmful purposes.

Article 7 (Ownership of Rights)

Intellectual property rights in the Service itself and in the software, designs, and trademarks provided by the Company belong to the Company. Users may not reproduce, distribute, or commercially use them without the Company’s prior consent.

Article 8 (Disclaimer)

• The Service is provided “as is,” and the Company is not liable for disruptions caused by reasons beyond its reasonable control, such as force majeure, the user’s device environment, or changes to operating systems or third-party services.
• Because User Content is stored on the device, the Company is not liable for data loss due to device resets, app deletion, insufficient storage, and the like. Please back up important content separately.

Article 9 (Limitation of Liability)

To the extent permitted by applicable law, the Company is not liable for indirect or incidental damages arising in connection with use of the Service.

Article 10 (Governing Law and Jurisdiction)

These Terms are governed by the laws of the Republic of Korea, and any dispute relating to use of the Service shall be subject to the court designated under applicable law.
